By accessing or using Residial ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including property managers, administrators, and trial users.
Residial provides an emergency alert and communication platform for property managers. The Service enables users to send automated voice calls and SMS text messages to residents in emergency situations, including but not limited to fire, flooding, gas leaks, power outages, and water main breaks.
To use the Service, you must:
You are responsible for all activity that occurs under your account.
Residial offers a 14-day free trial with no credit card required. At the end of the trial period, continued use of the Service requires a paid subscription. We reserve the right to modify or discontinue the free trial at any time without notice.
Residial charges on a per-door, per-month basis. Pricing tiers are as follows:
Subscriptions are billed monthly. You authorize Residial to charge your payment method on a recurring basis. All fees are non-refundable except as required by law.
You agree to use the Service only for lawful purposes. You may not:
Residial reserves the right to suspend or terminate accounts that violate these terms.
Residial is a communication tool and does not replace emergency services. You must always call 911 in life-threatening emergencies. Residial does not guarantee message delivery and is not liable for delays or failures in message transmission caused by carrier networks, device issues, or other factors outside our control.
You are solely responsible for the accuracy, legality, and appropriateness of all messages sent through the Service.
You represent and warrant that you have obtained all necessary consents from residents to receive automated voice calls and SMS text messages through the Service, as required by the Telephone Consumer Protection Act (TCPA) and any other applicable laws. Residial is not liable for your failure to obtain proper consent.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that any resident data you upload to the Service is handled in compliance with applicable privacy laws.
All content, features, and functionality of the Service are owned by Residial and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESIDIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO RESIDIAL IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Residial and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.
Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease and any data may be deleted after 30 days. Residial reserves the right to terminate accounts for violations of these Terms without notice.
Residial reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Mecklenburg County, North Carolina.
